FILES SUIT AGAINST RANDY BOGGESS AND
RANDY'S STEREO OUTLET FOR SELLING STEREO EQUIPMENT
OVER THE INTERNET AND FAILING TO DELIVER THE GOODS  
     

      Attorney General Darrell V. McGraw, Jr., today sued Randy Boggess, d/b/a Randy’s Stereo Outlet, a stereo equipment dealer located in St. Albans, West Virginia. Attorney General McGraw alleges that Mr. Boggess sold stereo equipment to consumers over the Internet and the telephone and failed to deliver the merchandise.

     Some consumers paid for stereo equipment and either received equipment inferior to what they paid for or did not receive any merchandise at all. Attorney General McGraw’s Consumer Protection Division has received consumer complaints from at least 30 irate consumers who purchased stereo equipment from Randy Boggess. One of the consumers, David Palmer of New Jersey, was so angry with Boggess that he created a webpage, www.monkeyfreak.com, that identifies Boggess’s latest scams.

     “It is just outrageous that someone would take a consumer’s hard earned money and not provide them with the merchandise they ordered,” said Attorney General McGraw.

     Attorney General McGraw seeks to halt Mr. Boggess’s business in West Virginia and seeks civil penalties in the amount of $5,000 for each violation of the West Virginia Consumer Credit and Protection Act. Attorney General McGraw also is asking the court to order Mr. Boggess to repay all aggrieved consumers.

     Attorney General McGraw urges all consumers who paid Mr. Boggess for stereo equipment they have not received to contact his Consumer Protection Division at (304) 558-8986, 1-800-368-8808.

Wow I know this guy personally! I have not seen him in about 5yrs but I would have never thought he would do this. I have to say however he did fall through a couple of times when I wanted to trade. He seemed to have an excuse most of the time. I finally gave up on him. I know he used to own a contruction business but I don't know how that turned out. Apparently things took a turn for the worse. This is sad and a blow to the high end community.
South43, this is not a blow to the high end community, it will be a victory for the ordinary Joe who has purchased or is thinking of purchasing items over the net. If David Palmer is the person who has been posting updates all over the web over this issue (can't remember if it's him) he should to be congratulated.
Turbodieselvw what I meant was that there are people who are miles from a brick and mortor business. Those who may have to resort to the net for purchases don't need any news such as this posting. Also with the ordinary Joe who again are miles away from a business the chance of him or her getting into hi end could lessen that opptunity. Just my 2$ worth.
I just came back from testifying at the preliminary injunction hearing. I was the first to testify. Mr. Boggess who had two weeks in which to secure a lawyer had arrived at the hearing sans lawyer. When the judge inquired as to where his counsel was he informed the judge "He is on a speaking tour." The WVAG was VERY prepared. They had contacted the lawyer whom Mr. Boggess had stated was supposed to represent him. That lawyer informed the WVAG in writing that he would not be representing Mr. Boggess days prior to the hearing! They promptly informed the judge.
